4 <br /> Applicable Law: <br /> 1. IPMC 108.5 Prohibited Occupancy: <br /> Any occupied structure condemned and placarded by the code official shall be <br /> vacated as ordered by the code official. Any person who shall occupy a placarded <br /> premises or shall operate placarded equipment, and any owner or any person <br /> responsible for the premises who shall/et anyone occupy a placarded premises or <br /> operate placarded equipment shall be liable for the penalties provided by this code. <br /> 2. EMC 8.20.020: <br /> No person owning, leasing, renting, occupying or having charge or possession of <br /> any property in the city, including vacant lots, shall maintain or allow to be <br /> maintained on such property except as may be allowed by any other city ordinance <br /> any of the following conditions visible from any public street, alley or other public or <br /> private property: <br /> (A) Junk, trash, litter, boxes, discarded lumber or salvage materials or other similar <br /> materials in any front yard, side yard, rear yard or vacant lot. <br /> (C) Broken or discarded furniture, household equipment and furnishings in any front <br /> yard, side yard, rear yard or vacant lot. <br /> (G) Vehicle parts or other articles or personal property which are discarded or left in <br /> a state of partial construction or repair in any front yard, side yard, rear yard or <br /> vacant lot. <br /> Conclusions of Law Based on Above Findings: <br /> 1. By failing to properly and adequately maintain the fire damaged structure in a safe <br /> and secure manor and by allowing the structure to become an attractive nuisance, <br /> and, by failing to maintain the property and allowing discarded items to remain on <br /> the property the Respondent violated IPMC 108.5 and EMC §8.20.020 (A), (C) and <br /> (G) This violation is a public nuisance. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent is in default and is in violation of IPMC 108.5 and <br /> EMC§ 8.20.020 (A), (C) and (G), and is hereby ordered to: <br /> 1. The Respondent shall abate all violations of IPMC 108.5 unsecured fire damage <br /> structure and EMC§ 8.20.020 (A), (C) and (G) mattresses, tires and miscellaneous <br /> trash and debris discarded on the property at 2620 Rucker Avenue, Everett, <br /> Washington. <br /> 2.
