RESOLUTION NO. 6798 <br /> A RESOLUTION authorizing recovery of abatement costs <br /> pursuant to EMC 1.20.090 at 1609 Walnut Street, Everett, Washington. <br /> WHEREAS,the Everett Municipal Code (the"EMC") Section 1.20.090 authorizes the <br /> City to abate code violations and recover the abatement costs; and <br /> WHEREAS,on March 20, 2014, April 3, 2014, and May 29, 2014 the City of Everett <br /> Violations Hearing Examiner issued an Order against the property owner Hinney 2 LLC (the <br /> "Owner") for EMC violations at 1609 Walnut Street(the"Property"),parcel number <br /> 00619732600400, and abbreviated legal description: <br /> YOUNGS ADD TO EVERETT U P BLK 326 D-00-LOT 4&N 23 1/2 FT OF LOT 5 <br /> WHEREAS the Owner failed to abate the violations, including applying for and <br /> obtaining all of the necessary and required City permits to bring the structure on the property into <br /> compliance with the EMC and vacating all occupants by the date set by the March 20, 2014 <br /> Order; <br /> WHEREAS,an Order of the City of Everett Code Official was sent to the Owner <br /> requiring immediate abatement of the above-described violations, and explaining that failure to <br /> do so would result in the City abating the violations on the Property, and that those costs together <br /> with any penalties imposed by the Hearing Examiner may become a lien against his property if <br /> the Owner failed to reimburse the City the abatement costs; <br /> WHEREAS,the City, through a contractor, conducted the abatement including securing <br /> the structure from trespass on September 24, 2014; <br /> WHEREAS,the City incurred costs in the amount of$1,685.01 in its abatement of the <br /> violations and the Hearing Examiner imposed a penalty of$2,500.00 against the Owner; <br /> WHEREAS,the Owner has failed to timely pay the penalty and abatement costs; and <br /> WHEREAS,notice of Council's consideration of this Resolution was provided to the <br /> Owner; <br /> 1 <br />
