ORDINANCE NO.... /a2 -09 <br /> An Ordinance relating to the Municipal Court System, specifically the <br /> appointment of Judges Pro Tern, amending Ordinance No. 1259-86 as <br /> amended by Ordinance No. 2228-97 (EMC 2.108.060) <br /> WHEREAS, chapter 3.50 RCW governs Municipal Court systems, including <br /> their establishment and administration for cities such as Everett; and <br /> WHEREAS, RCW 3.50.090 governs the designation of one or more persons as <br /> judges pro tem who may serve after appointment subject to the qualifications stated <br /> therein; and <br /> WHEREAS, Everett Municipal Code 2.108.060 provides for the appointment of <br /> judges pro tern for the Everett Municipal Court; and <br /> WHEREAS, the City wishes to update its municipal court procedures to avoid <br /> the appearance of, or potential for, inconsistency between State and local procedures; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 6 of Ordinance No. 1259-86 as amended by Section 3 of <br /> Ordinance No. 2228-97 (EMC 2.108.060) which reads as follows: <br /> Judges pro tem. <br /> The mayor shall, in writing, appoint judges pro tem who shall act in such matters as <br /> requested by a regular judge or in the absence or disability of the regular municipal court <br /> judges or subsequent to the filing of an affidavit of prejudice. A municipal judge pro tern <br /> shall be an attorney admitted to practice law before the courts of record of the state of <br /> Washington and a citizen of the state of Washington and of the United States of America. <br /> The municipal court judges pro tern shall be compensated at the rate of two hundred <br /> dollars per day or appropriate portions thereof as determined by the municipal judge. The <br /> per diem rate may be adjusted either by amendment to this section or in the annual budget <br /> ordinance or in the annual salary ordinance. The term of appointment shall be specified in <br /> writing, but shall not extend beyond the term of the appointing mayor. <br /> BE AND THE SAME IS HEREBY AMENDED 'TO READ AS FOLLOWS: <br /> Judges pro tem. <br />
