• <br /> a ' <br /> # 111 m1111°'''J <br /> ORDINANCE NO. 3135-09 <br /> An Ordinance relating to Regulation of Vessels, <br /> Amending Ordinance 1246-86 §1 (part), 1986 (Chapter 12.02 EMC), <br /> Adding Sections to Ordinance 1246-86 §1 (part), <br /> Repealing a Section of Ordinance 1246-86 §1 (part), <br /> and Amending Section 1 of Ordinance 3051-08 as amended <br /> by Section 3 of Ordinance 2834-05 (EMC 12.02.175). <br /> Whereas, the State of Washington legislature and State Parks and Recreation <br /> Commission have made numerous revisions to vessel regulation legislation and rules since <br /> Everett enacted Ordinance No. 1246-86 §1 (part) (Regulation of Vessels); and <br /> Whereas, continued receipt of boating safety grant monies is dependent in part upon <br /> enforcement of State vessel regulations laws and rules; and <br /> Whereas, the City of Everett has the power to license, regulate, control or restrain boats <br /> used in its jurisdiction; and <br /> Whereas, the City of Everett has the power to provide for the punishment of all practices <br /> dangerous to public health or safety, and to make regulations necessary for the preservation of <br /> public health, peace and good order and to provide for the punishment of all persons charged <br /> with violating any city ordinances; and <br /> Whereas, the Everett Municipal Court has the authority to hear and determine pursuant <br /> to Chapter 7.80 RCW civil infractions that are established by municipal ordinance and that are <br /> committed within the jurisdiction of the municipality, and <br /> Whereas, the Everett City Council deems it appropriate for the city's vessel regulations <br /> to be the same as State vessel regulations; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Ordinance 1246-86 §1 (part), 1986 (EMC 12.02.010), which reads as follows: <br /> Definitions. <br /> When used in this chapter the following words and phrases shall have the meanings designated <br /> in this section unless a different meaning is expressly provided or unless the context clearly <br /> indicates otherwise. <br />
