A. Except as provided in Chapter 88.02 RCW, no person may own or operate any vessel on <br /> waters subject to this chapter unless the vessel has been registered and displays a registration <br /> number and a valid decal in accordance with Chapter 88.02 RCW, except that a vessel which has <br /> or is required to have a valid marine document as a vessel of the United States is only required to <br /> display a valid decal. <br /> B. Except as otherwise provided in Chapter 88.02 RCW, a violation of this section is an <br /> infraction punishable by a fine of one hundred twenty-five dollars. <br /> C. Municipal court judges and judges pro tern shall have discretion to assess additional <br /> penalties for failure to pay or respond to notices of infractions issued under this section as <br /> otherwise allowed by law. <br /> Section 26: Ordinance 1246-86 § 1 (part), 1986 (EMC 12.02.180), which reads as follows: <br /> Penalties. <br /> Unless otherwise provided, any person violating or failing to comply with any of the provisions <br /> of this chapter shall be guilty of a misdemeanor,punishable by a fine in any sum not exceeding <br /> one thousand dollars. <br /> Is hereby amended to read as follows: <br /> Penalties. <br /> A. Unless otherwise provided, a violation of this chapter is an infraction, punishable in <br /> accordance with IRLJ 6.2(d)(4). <br /> B. A violation of this chapter designated as an infraction is a misdemeanor punishable under <br /> EMC 10.04.080.B if the current violation is the person's third violation of the same provision of <br /> this chapter during the past three hundred sixty-five days. <br /> C. Costs and assessments required by state law shall be added to the base penalty for <br /> infractions and remitted as set forth in state law. These costs and assessments cannot be <br /> suspended or waived. <br /> Section 27: General duty. <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety and <br /> welfare of the general public and not to create or otherwise establish or designate any particular <br /> class or group of persons who will or should be especially protected or benefited by the terms of <br /> this ordinance. It is the specific intent of this ordinance that no provision nor any term used in <br /> this ordinance is intended to impose any duty whatsoever upon the city or any of its officers or <br /> employees. Nothing contained in this ordinance is intended nor shall be construed to create or <br /> form the basis of any liability on the part of the city, or its officers, employees or agents, for any <br /> injury or damage resulting from any action or inaction on the part of the city related in any <br /> manner to the enforcement of this ordinance by its officers, employees or agents. <br /> 23 <br />
