. . • <br /> ,IIW <br /> ORDINANCE NO. 315 4-0 9 <br /> An Ordinance amending Ordinance No. 2530-01, Extending the Effective Period for <br /> Preliminary Approval of Short Subdivision and Binding Site Plan applications <br /> WHEREAS,Under EMC Chapter 15.20.210.A, expiration of preliminary subdivision approvals <br /> occurs after five years and under EMC Chapter 15.20.210.B, expiration of preliminary short <br /> subdivision and binding site plans occurs after three years; and <br /> WHEREAS,there are currently no time extensions available for preliminary short subdivision <br /> and binding site plan approvals; and <br /> WHEREAS,the City of Everett has approved a substantial number of short subdivision <br /> applications that have been unable to obtain final approval due to unfavorable economic <br /> conditions; and <br /> WHEREAS,the City Council finds that the unusual and unprecedented economic conditions <br /> recently encountered across the nation may result in projects that would otherwise be beneficial <br /> to the City losing their vesting rights unless additional time can be allowed to secure project <br /> financing and construction permits; and <br /> WHEREAS,the City Council finds that allowing additional time for approved projects to secure <br /> project financing and construction permits is both necessary and beneficial to the City. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 15.20.210.B of Ordinance No. 2530-01 which reads as follows: <br /> Expiration of Preliminary Short Subdivision or Preliminary Binding Site Plan Approval. Final <br /> short subdivision or final binding site plan approval must be obtained within three years of <br /> preliminary approval, after which time the preliminary approval will be void. No extension may <br /> be granted by the city to the applicant. <br /> is hereby amended to read: <br /> Expiration of Preliminary Short Subdivision or Preliminary Binding Site Plan Approval.
