ORDINANCE NO. 3165-09 An Ordinance approving site plan modifications to Planned Residential Development No. PRD79-006,to allow an expansion of the community building at Everett Housing Authority's Pine View Community Center. WHEREAS, in 1980 the City of Everett adopted Ordinance No. 664-80 approving development of a 34 unit planned residential development(PRD) subject to a development contract, which was subsequently constructed in accordance with the approved PRD site plan; and WHEREAS, the Everett Housing Authority has proposed increasing its community center from 1,088 s.f. to 3,800 s.f. to better address resident needs and increased on-site management; and WHEREAS, PRDs include specific site plan and building design approval; and WHEREAS, prior to approving modifications to site and building design which increase building coverage and/or decreases open space the Everett Municipal Code requires City Council approval following a public hearing; and WHEREAS, on November 12, 2009, the Hearing Examiner held a public hearing on the proposed amendment to the PRD site plan; and WHEREAS,the City Council is required to review the record and recommendation of the Hearing Examiner; and WHEREAS,the Hearing Examiner found the proposal to be in the best long term interest of the City of Everett and that impacts to the City,the general vicinity and the developed PRD to be minimal. NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: SECTION 1: The PRD amendment is hereby approved, subject to the conditions of approval in the Hearing Examiner findings and recommendation dated November 16, 2009, a copy of which is attached hereto as Exhibit A, and incorporated herein by reference. SECTION 2: Nothing in this ordinance shall be construed as abating any official action of the City now pending under or by virtue of any of the ordinances herein amended or superseded by
