ORDINANCE NO. 3167-09 <br /> An Ordinance related to Zoning Code design standards, amends <br /> Titles 15 and 19 EMC as provided in Section 5 of this Ordinance. <br /> WHEREAS, the Zoning Code contains several sections that contain standards and guidelines <br /> pertaining to the design of buildings, sites or other improvements to property; and <br /> WHEREAS, occasionally it is necessary to seek the professional services of a licensed architect <br /> or other licensed design professional to assist in the review of plans for a project that is subject to <br /> the design standards and guidelines of the zoning code; and <br /> WHEREAS, in 2006 the City adopted new design standards for the B-3 zone; and <br /> WHEREAS, in 2008 the City established the Broadway Mixed Use (BMU) zone which includes <br /> design standards and guidelines; and <br /> WHEREAS, most sections of the Zoning Code that include design standards and guidelines <br /> provide the opportunity for an applicant to propose alternative design measures to those stated in <br /> the Code; and <br /> WHEREAS, the B-3 zone and BMU amendments do not include the opportunity for an applicant <br /> to propose an alternative approach to the design measures stated in the Code; and <br /> WHEREAS, the Planning Commission held a public hearing on November 18, 2009, and <br /> adopted a resolution recommending that the City Council approve the proposed amendments to <br /> the Zoning Code; and <br /> WHEREAS, the City Council finds that the proposed amendments in this ordinance: <br /> 1. Are consistent with the applicable provisions of the Everett Comprehensive Plan; <br /> 2. Bear a substantial relation to the public health, safety and welfare; <br /> 3. Promote the best long term interests of the Everett community. <br /> NOW,THEREFORE, THE CITY DOES HEREBY ORDAIN: <br /> Section 1: Chapter 2 of Ordinance No. 1671-89 (EMC Chapter 19.02), as amended, is hereby <br /> amended by the addition of the following, which shall be codified as EMC 19.02.090: <br /> Page 1 of 12 <br />
