,tilwill ORDINANCE NO. 3185-10 An Ordinance Amending the Local Project Review Procedures for Review Process II, amending Ordinance No. 2530-01, as amended (EMC Title 15). WHEREAS, it is necessary to amend the City's land use code and procedural requirements from time to time to address changing circumstances and emerging needs; and WHEREAS, the City Council adopted the Local Project Review Procedures Ordinance No. 2530-01 to implement RCW Chapter 36.70B to provide a master procedural ordinance for land use applications within the City of Everett, including public notice requirements for various types of land use applications; and WHEREAS, the public notice requirements for Review Process II (Planning Director review) include mailing to contiguous property owners; and WHEREAS, there exists numerous property configurations in the City that could result in insufficient public notice using the common definition of contiguous; and WHEREAS, the City Council finds that the amendment is necessary to provide clarification so property owners receive adequate notice for Review Process II applications; and WHEREAS, the City's Review Procedures regulations need to be revised to allow the Planning Director to review use of basements and other areas within the B-3 zone using the Process II Review; and WHEREAS, the City Council finds that the proposed amendment promotes the best long term interests of the Everett Community. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Subsection 3(B) of Chapter 4 of Ordinance No. 2530-01, as amended (EMC 15.16.080), which reads as follows: Decisions included.
