ORDINANCE NO. 3 212-11 <br /> AN ORDINANCE ASSUMING JURISDICTION OVER A PORTION OF THE MUKILTEO WATER <br /> AND WASTEWATER DISTRICT'S RESPONSIBILITIES,PROPERTY,FACILITIES AND EQUIPMENT <br /> IN AREAS PREVIOUSLY ANNEXED TO THE CITY UNDER ORDINANCE 2422-99 AND <br /> ORDINANCE 2375-99 <br /> WHEREAS, the City of Everett (the "City")and the Mukilteo Water and Wastewater <br /> District of Snohomish County (the "District") are parties to the Annexation Agreement <br /> dated May 23,1984 (the "Agreement"); and <br /> WHEREAS, the City annexed areas under Ordinance 2422-99 and Ordinance 2375-99 <br /> that are part of the territory of the District; and <br /> WHEREAS, the Board of Commissioners of the District passed Resolution 172-11 on <br /> January 5, 2011; and <br /> WHEREAS, Resolution 172-11 approved the transfer to the City of the District's <br /> responsibility for the area shown in Exhibit A to this Ordinance (the "Annexation Area"), <br /> which is a portion of the area annexed to the City of Everett under Ordinance 2422-99 <br /> and Ordinance 2375-99; and <br /> WHEREAS, Resolution 172-11 approved the transfer to the City of the District's <br /> property, facilities, and equipment shown in Exhibit B to this Ordinance (collectively, the <br /> "Annexation Area Facilities"); and <br /> WHEREAS, Resolution 172-11 contained a list of the $151.895.19 of outstanding <br /> indebtedness related to the Annexation Area, which list is attached to this Ordinance as <br /> Exhibit C (collectively, the "Annexation Area Outstanding Debt"); and <br /> WHEREAS, the City desires to assume the Annexation Area, to assume the Annexation <br /> Area Facilities, and to pay to the District the Annexation Area Outstanding Debt; and <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Assumption <br /> Effective as of 12:01 a.m. January 1, 2011 and consistent with the Agreement and <br /> Chapter 35.13A RCW, the City accepts the transfer of and assumes the Annexation Area, <br /> accepts the transfer of and assumes the Annexation Area Facilities, and agrees to pay to <br /> the District the Annexation Area Outstanding Debt in accordance with the payment <br /> amounts and due dates listed in Exhibit C. <br /> AN ORDINANCE ASSUMING JURISDICTION OVER A PORTION OF THE MUKILTEO WATER AND <br /> WASTEWATER DISTRICT'S RESPONSIBILITIES,PROPERTY,FACILITIES AND EQUIPMENT <br /> PAGE 1 OF 2 <br />
