01811441.7 ORDINANCE NO. 2821-05 AN ORDINANCE providing for the vacation of a portion of 25" Avenue S.E. lying south of 101st Ave. S.E. and north of 104 PI. S.E. WHEREAS, the CityCouncil of the City of Everett, did by Resolution No. 5535 duly adopt and fix the 3rddayof November, 2004 at 6:30P.M., as the date of public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; and WHEREAS, the City Council fipds it would not vacate said rights of way could it not retain easements for utilities in 25 Avenue S.E., to be vacated; and WHEREAS, it now appears to the City Council of the City of Everett that the said right of way resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance: NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: The East 20 feet of the North One-Half of the Southwest Quarter of the Northeast Quarter of the Northwest Quarter of Section 20, Township 28 North, Range 5 East W.M., and The West 20 feet of the Southeast Quarter of the Northeast Quarter of the Northwest Quarter of Section 20, Township 28 North, Range 5 East W.M. All situate in the City of Everett, County of Snohomish, Washington be and the same is hereby vacated pursuant to the conditions set forth in this ordinance.
