ORDINANCE NO. 2831-05 <br /> 10411111 .1 <br /> AN ORDINANCE AMENDING THE INTERIM REGULATIONS Fe 7 - 1 <br /> DOWNTOWN EVERETT'AREA, ORDINANCE NO. 2803-04, AND AMENDING <br /> SECTION 4 OF ORDINANCE NO. 1671-89 (EMC 19.04) CONCERNING <br /> DEFINITIONS RELATED THERETO. <br /> WHEREAS, the City Council adopted Ordinance No. 2803-04 on November 17, <br /> 2004, declaring an emergency to exist and establishing interim regulations on the <br /> processing of applications for specified uses within the downtown Everett area; and <br /> WHEREAS, the City Council finds: <br /> 1. The area covered by Ordinance No. 2803-04 needs to be revised; and <br /> 2. The City Council is still concerned about the general economic health of <br /> downtown Everett as expressed in the findings contained in Ordinance <br /> No. 2803-04; and <br /> 3. It is still in the public interest to protect the substantial public and private <br /> investments that have recently been made in downtown by requiring a <br /> review process for the uses specified within this ordinance that adequately <br /> addresses all potential impacts of said uses; and <br /> 4. The City will be conducting a planning effort to comprehensively <br /> examine a number of issues concerning the future development of <br /> downtown Everett; and <br /> 5. Upon the completion of said planning process, it is anticipated that <br /> permanent regulations concerning allowable uses and appropriate review <br /> processes will be adopted and replace the interim regulations contained <br /> herein; and <br /> 6. Ordinance No. 2803-04 is effective from November 17, 2004, through <br /> May 17, 2005; and <br /> 7. RCW 35.63.200 and RCW 36.70A.390 and the City Charter, Article III, <br /> authorize the Council to enact interim regulations on land use matters to <br /> preserve the status quo while new plans or development standards are <br /> considered and prepared; and <br /> 8. The Council wishes to preserve the status quo through these interim <br /> regulations to allow time to consider whether additional land use <br /> regulations may be necessary or appropriate to minimize the adverse <br /> social, economic or environmental impacts potentially generated by uses <br /> inconsistent with the City's ultimate plans and development regulations; <br /> and <br /> 9. The current interim regulations will expire as of May 17, 2005, unless <br /> further extended. An extension of the interim regulations for an <br /> 1 <br />
