der ORDINANCE Na 2835-05 AN ORDINANCE amending the City's License Code for th- - • • of hotels and motels, amending Chapter 25 of Ordinance No. 295-74 as amended (EMC 5.100) Whereas,the City Council of the City of Everett finds that the type, severity, and frequency of criminal activity relating to drugs and prostitution occurring at some overnight lodging facilities are a real and compelling concern to the Everett Police Department, the citizens of Everett, visitors to Everett, and the overnight lodging industry itself; and Whereas,the City Council of the City of Everett finds that there is a substantial public interest in restraining such illegal activity and nuisances associated with problem overnight lodging facilities; and Whereas, the City Council of the City of Everett finds that the public would benefit from a clarification of the process for hearings and appeals of license suspensions and revocations under the license code; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Chapter 25 of Ordinance No. 295-74 (Chapter 5.100 EMC), which is entitled as follows: HOTELS AND APARTMENT HOUSES Be and the same is hereby amended to be entitled as follows: OVERNIGHT LODGING Section 2: Chapter 25, Section 1 of Ordinance No. 295-74 (EMC 5.100.010), which reads as follows: Hotel defined. For the purpose of this chapter a hotel shall mean every building or structure kept, used or maintained as, or advertised as, or held out to the public to be an inn, hotel or public lodging house or place where sleeping accommodations are furnished to the public for hire, in periods of less than one week, in which four or more rooms are used for sleeping accommodation of guests.
