issue a written decision as to the suspension or revocation of such license or its retention. <br /> Such decision of the city council shall be final; if the city council decides that the license <br /> shall be suspended or revoked, the suspension or revocation shall be effective as of the <br /> date of city council's decision unless otherwise ordered by a court of competent <br /> jurisdiction. Appeal of the city council's decision to a court of competent jurisdiction <br /> must be instituted within fifteen days of final action of the city council. <br /> D. Surrender of License. It is unlawful for any person whose license has been suspended <br /> or revoked, to keep the license issued to him in his possession or under his control, and <br /> the same shall immediately be surrendered to the city clerk. When revoked, the license <br /> shall be cancelled, and when suspended the city clerk shall retain the same during the <br /> period of suspension. <br /> Section 11: Savings. Nothing in this ordinance shall be construed as abating any official <br /> action of the City now pending under or by virtue of any of the ordinances herein <br /> amended by th adoption of this ordinance or as waiving any right of the City under the <br /> provisions amended by the adoption of this ordinance. <br /> Section 12: Severability. If any section, subsection, paragraph, sentence, clause or <br /> phrase set forth in this ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decisions shall not affect the validity of <br /> the remaining portions of this ordinance or its application to any other person or situation. <br /> The City Council of the City of Everett hereby declares that it would have adopted this <br /> ordinance and each section, subsection, sentence, clause,phrase, or portion thereof <br /> irrepective of the fact that any one or more sections subsections, sentences, clauses, <br /> phrases or portions be declared invalid or unconstitutional. <br /> Section 13: Third Party Liability. It is expressly the purpose of this ordinance to <br /> provide for and promote the health, safety, and welfare of the general public and not to <br /> create or otherwise establish or designate any particular class or group of persons who <br /> will or should be especially protected or benefited by the terms of this ordinance nor <br /> create any duty for the City. Nothing contained in this ordinance is intended nor shall be <br /> construed to create or form the basis of any liability on the part of the City, or its officers, <br /> employees or agents, for any injury or damage resulting from any action or inaction on <br /> the part of the City, its officers, employees or agents. Nothing contained in this ordinance <br /> is intended nor shall be construed to create or form the basis of any civil liability to third <br /> parties on the part of a licensee, or its servant, agents or employees. <br /> Section 14: Corrections. The city clerk and the codifiers of this ordinance are <br /> authorized to make necessary corrections to this ordinance including, but not limited to, <br /> 7 <br />
