0011.1", <br /> ORDINANCE NO. 2836-05 <br /> AN ORDINANCE RELATING TO THE LOCATION OF <br /> ADULT RETAIL BUSINESS USES, AMENDING <br /> ORDINANCE NO. 1671-89 (AS AMENDED), TITLE 19 EMC <br /> WHEREAS, the City Council does find: <br /> 1. A variety of cities, counties and states have conducted studies and received <br /> evidence relating to the adverse impacts of the distribution of adult-oriented merchandise <br /> by adult retail businesses. These studies include information related solely to <br /> establishments that engage in retail-only sales of such merchandise for off-premises <br /> viewing, as well as studies that relate to businesses which engage in both retail sales of <br /> adult-oriented merchandise and other adult entertainment activities; <br /> 2. The City has considered such studies and evidence as compiled in a legislative <br /> record for this ordinance. In addition, the City has considered a variety of other evidence <br /> in the record, including court cases, police records, memoranda and other information <br /> related to the distribution of adult-oriented merchandise; <br /> 3. The City finds that such information about adult retail businesses that distribute <br /> adult-oriented merchandise, and engage in no other adult entertainment activities (i.e., <br /> "retail-only" businesses) indicates that they create adverse secondary effects, including <br /> health, safety, economic, and aesthetic impacts, upon neighboring properties and the <br /> community as a whole, and that they have adverse impacts upon minors; <br /> 4. The City finds that such information about adult retail businesses that distribute <br /> adult-oriented merchandise in addition to other adult entertainment activities (i.e., not <br /> "retail-only" businesses) is reasonably related to the regulation of retail-only <br /> establishments, and that such information also indicates that all of these establishments <br /> cause or tend to cause the same or similar adverse secondary effects; <br />
