2. This evidence and all other evidence in the legislative record for this ordinance support the conclusion that regulation of adult retail businesses by separating them from sensitive uses such as schools, parks, residential zones and places of worship, and separation of such businesses from each other, will both diminish the adverse secondary effects and improve the quality of living within the City; and 3. The distribution of adult-oriented merchandise, including printed and photographic materials, is protected by the constitutions of the United States and the State of Washington, and that this ordinance is intended to protect such rights while addressing the adverse impacts of establishments that distribute such merchandise; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1.
