8. To the best of the City's knowledge, two retail marijuana businesses are in the <br /> process of obtaining approval and licenses from the State Liquor Control Board and will be <br /> required to find locations which comply with the amendments made in this Ordinance unless <br /> they obtain State Liquor Control Board approval and obtain a City business license prior to the <br /> effective date of this Ordinance; and <br /> 9. The City's interests are best served by continuing under interim regulations <br /> because the City has had limited experience with marijuana businesses operating in the City, <br /> pending litigation may potentially impact the City's ability to zone marijuana businesses, the <br /> State Legislature may take legislative action impacting the City's ability to zone marijuana <br /> businesses, and substantial uncertainty continues to exist as to the appropriate and necessary <br /> zoning for marijuana businesses; and <br /> 10. Modifying and extending the current interim zoning regulations will continue to <br /> allow the City to take a measured approach which honors the spirit of state law and acts as a pilot <br /> project allowing marijuana businesses only in areas that have the greatest likelihood to be <br /> permissible areas after full consideration of the proper regulation of marijuana businesses and <br /> experience with the impacts of such businesses; and <br /> 11. A State Environmental Policy Act, RCW 43.21C, Addendum to Final <br /> Determination of Non Significance (SEPA#13-015) for the regulation of marijuana businesses <br /> was issued on December 19, 2014; and <br /> 12. The City held a public hearing on the date of adoption of this Ordinance; and <br /> 13. Nothing in this Ordinance is intended to encourage any use or activity that <br /> violates federal law; and <br /> Whereas, the City Council concludes that: <br /> 1. The City does have the authority to modify and readopt interim regulations; and <br /> 2. The City must adopt interim regulations concerning the location of recreational <br /> marijuana businesses to act as a stop-gap measure: (a) to protect the City's interests in the face of <br /> substantial uncertainty related to the zoning and regulations of recreational marijuana businesses, <br /> (b) to provide the City an opportunity to further study the issues concerning the appropriate <br /> zoning or regulation of such recreational marijuana businesses, the practical effects of <br /> operational recreational marijuana businesses, and prepare appropriate revisions to the City's <br /> regulations; and (c) to avoid marijuana businesses establishing vested rights contrary to and <br /> Page 2 of 8 <br />
