Condition � 23 oFtile CEMEX permit (S�-IA #8-00�) provides a t�vo year <br />timeti•ame from thc "e[�fective date' to begin the construction authorized tmder the permit. WAC <br />1T-27-090(4j states in part, "Thc permit time periods ...do not incluc3e the time during �.vhich a <br />Lise or acti�-ity �vas not actu�illy l�ursi�ecl duc to the pendcncy of achninistcative appeals or Iegal <br />actions or due to the �1eed to obtai�l any other go��ernment permits and approvals for t}Ie <br />developnient ihat authorizes the development to proceed,...". Based on the clate of issuance of <br />your Army Corps of��n��ineers Permit (N�VS-2008-82�), the "effective date" of your Shoreline <br />Permit is Ivlarch 26, ?010. Thc initial t�vo-year permit timeframe therefore lapses on \�Iarch 26, <br />2012. <br />In your letter and accompailying siti; plan (attached), you deseribe specific '`3'hase Onc" <br />improvements to be made by CEMEX in the summer of 2012, to �n-ovide public access on site in <br />ihe fornl of a p�king area, 10 foot �vide asphalt trail, and a picnic area (witl� t���o picnic tables) <br />along the southern bouudary of the propert��. 'I�hese improvemen[s �vill also include signage for <br />the property. <br />Condition �4 of the shoreline permit requires that the 10 Coot ���ide p�ved public access trail be <br />eatended al�ng the entire shoreline (yolir `'Phase Two" improvement) unless ��ater <br />dependent/pier ac�i��ities make that public us� of the area inFeasible. 1�he email you pi-ovided on <br />March 6, 2012 indicated that there are concerns about soil contamination in the area �vhere this <br />trail is proposed.
