ORDINANCE NO. 2842-05 <br /> AN ORDINANCE establishing a Downtown Business Improvement Area <br /> (BIA); providing for the levy of a special assessment upon real property <br /> (and the owners thereof) within the area; the deposit of revenues in a <br /> special account and expenditures therefrom, providing for an implementing <br /> agreement with a downtown Everett property owners association, or similar <br /> organization and repealing Ordinance No. 2049-95. <br /> 020 11 <br /> WHEREAS, the City Council, pursuant to Resolution No. 5639, adopted June 15, 2005, <br /> declared its intent to initiate and establish a new Downtown Everett Business Improvement Area <br /> pursuant to Chapter 35.87A RCW, and disestablish, terminate and dissolve the old BIA; and <br /> WHEREAS, the City Council, on June 29, 2005, adopted Resolution No.5644 ,disestablishing, <br /> terminating and dissolving the present esisting BIA upon the establishement of a new BIA and <br /> initiating a new Downtown Everett Business Improvement Area; and <br /> WHEREAS, as provided in Resolution No. 5639, the City Council held a public hearing on <br /> June 29, 2005 in the Everett City Hall Council Chambers, concerning the formation of the <br /> Downtown Business Improvement Area and the imposition of special assessments on property <br /> (and property owners) within such Business Improvement Area, prior to the adoption of this <br /> ordinance; <br /> NOW, THEREFORE BE IT ORDAINED BY THE CITY OF EVERETT: <br /> Section 1. ODINANCE REPEALED. <br /> Ordinance No. 2097 is repealed as of the effective date of this Ordinance. <br /> Section 2. DISTRICT ESTABLISHED. <br /> As authorized by Chapter 35.87A RCW, there is hereby established a Downtown Everett <br /> Business Improvement Area (BIA) within the following described boundaries (when a street or <br /> alley is named, the District boundary is the center line of the right-of-way unless otherwise <br /> stated): <br /> Beginning at the intersection of the centerline of Pacific Avenue and the centerline of the <br /> alley west of Hoyt Avenue, thence north along the centerline of the alley west of Hoyt <br /> Avenue to a point, said point being the intersection of the south line of lot 5, block 681, <br /> Plat of Everett projected easterly to the centerline of said alley, thence west along said <br /> projected line and the south line of lot 5, block 681, Plat of Everett and the westerly <br /> projection thereof to the centerline of Rucker Avenue, thence north along the centerline <br /> of Rucker Avenue to a point, said point being the intersection of the north line of lot 9, <br /> 1 <br />
