NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The Concomitant Agreement to Rezone Ordinance No. 592-79 shall be void. All <br /> future development of the subject property shall be in compliance with the development <br /> standards for the C-1 zone in Chapter 19 of the Everett Municipal Code. <br /> Section 2. Zoning Map amended: The official zoning map of City of Everett is hereby amended <br /> from "C-1 with Contract"to "C-1". The subject property is shown in the attached"Exhibit A" <br /> and is legally described as follows: <br /> All that portion of the East half of Government Lot 4, Section 7, Township <br /> 28 North, Range 5 East, W.M., described as follows: Commencing at the <br /> Southwest corner of the Southwest quarter of said Section 7; thence North <br /> along the West line of said Section 7, for a distance of 30.00 feet to the <br /> North boundary line of Beverly Park-Mukilteo Road, as laid out and <br /> constructed; thence Easterly along the North line of said road for a distance <br /> of 773.25 feet to the True Point of Beginning: thence Northerly and parallel <br /> with the West line of said section for a distance of 385.05 feet; thence <br /> Easterly parallel with the South line of section for a distance of 123.41 feet; <br /> thence Southerly and parallel with the West line of said section 7 to the <br /> North line of said Beverly Park-Mukilteo Road; thence Westerly and <br /> following the Northerly line of said Beverly Park-Mukilteo Road to the True <br /> Point of Beginning. Situated in Snohomish County, Washington. <br /> EXCEPT any portion lying Northerly of the Southerly Margin of State <br /> Route 526. <br /> SUBJECT TO Water line easement filed under Auditor's File No. 2029737, <br /> Records of Snohomish County, State of Washington. <br /> Section 3. Severability. Should any section,paragraph, clause or phrase of this Ordinance, <br /> or its application to any person or circumstance, be declared unconstitutional or otherwise <br /> invalid for any reason, or should any portion of this Ordinance be pre-empted by state or <br /> federal law or regulations, this shall not affect the validity of the remaining portions of this <br /> Ordinance or its application to other persons or circumstances. <br /> Section 4. Conflict. In the event there is a conflict between the provisions of this <br /> Ordinance and any other City ordinance, the provisions of this Ordinance shall control. <br /> 2 <br />
