./tIP <br /> tiolii <br /> Ordinance No. 2844-05 <br /> An Ordinance relating to Municipal Judge Salaries, <br /> Amending Section 4 of Ordinance No. 1259-86, as Amended by Section 2 of Ordinance <br /> No. 2228-97 and Section 1 of Ordinance No. 2544-01 (EMC 2.108.040). <br /> Whereas,the 2005 State Legislature enacted E2SSB 5454 to recognize the <br /> State's obligation to provide adequate representation to criminal indigent defendants and <br /> to parents in dependency/termination cases, and to improve trial courts; and <br /> Whereas, E2SSB 5454 creates a dedicated revenue source, a portion of which <br /> will be for State contributions to district and qualified municipal court judicial salaries; <br /> and <br /> Whereas, to qualify for a State contribution to Everett Municipal Judges' salaries <br /> the City of Everett must establish by ordinance that a full-time judge is compensated at a <br /> rate equivalent to at least 95%, but not more than 100%, of a district court judge salary or <br /> for a part-time judge on a pro rata basis the same equivalent; and <br /> Whereas,the City of Everett sets the salaries of its elected officials including <br /> those of the Everett Municipal Judges through the use of a Citizens' Commission on <br /> Salaries of Elected Officials as provided in Section 2.8 of the City of Everett Charter; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 4 of Ordinance No. 1259-86, as Amended by Section 2 of Ordinance <br /> No. 2228-97 and Section 1 of Ordinance No. 2544-01 (EMC 2.108.040) is amended by <br /> the addition of the following section: <br /> For purposes of E2SSB 5454 (laws of 2005 legislative session), the City <br /> of Everett establishes by this ordinance that a full-time municipal judge is <br /> compensated at a rate equivalent to at least ninety-five percent, but not <br /> more than one hundred percent, of a district court judge salary and a part- <br /> time municipal judge is compensated on a pro rata basis the same <br /> equivalent. <br /> Section 2: Codification. Section 1 of this ordinance shall be codified as EMC <br /> 2.108.040.C. <br /> Section 3: Corrections. The City Clerk and the codifiers of this ordinance are authorized <br /> to make necessary corrections to this ordinance including, but not limited to, <br />
