ACCEPTANCE OF TERMS AND CONDITIONS <br /> WHEREAS, the City Council for the City of Everett duly adopted Ordinance 3218-11 on <br /> April 27, 2011 (the"Ordinance"), granting Providence Health& Services—Washington, dba <br /> Providence Regional Medical Center Everett("Providence")permission to construct, maintain <br /> and operate an enclosed Pedestrian Skybridge and a Utility Corridor over, across and under 13th <br /> Street at the locations legally described on Attachment A; <br /> WHEREAS, Mayor Ray Stephanson signed and the City published said Ordinance, <br /> making it effective as of May 13,2011; and <br /> WHEREAS, Section 19 of the Ordinance requires that Providence deliver to the City <br /> Clerk a fully executed acceptance of the terms and conditions of this Ordinance on a form <br /> acceptable to the City Attorney within thirty(30) days after the City Council's adoption of this <br /> Ordinance,together with the"One-Time Fee" of Thirty Thousand Seven Hundred Twenty <br /> Dollars($30,720); <br /> NOW, THEREFORE: <br /> PROVIDENCE accepts the terms and conditions of the Ordinance, agrees that it is bound <br /> by the terms and conditions of the Ordinance, and delivers this Acceptance of Terms and <br /> Conditions,"together with the required One-Time Fee,to the City Clerk. <br /> Dated this 20 day of May, 2011 <br /> PROVIDENCE HEALTH& SERVICES— <br /> WASHINGTON <br /> (dba Providence Regional Medical Center Everett) <br /> i /700t/Ie./ <br /> y: David T.
