10. The Applicant has applied to rezone the Property to R-5 without Development <br /> Agreement, to nullify the Amended Development Agreement and affirm the current <br /> Comprehensive Plan Designation for the Property; and <br /> 11. In 2008 the City adopted design and development standards for the core residential area <br /> controlling future development on Lots 1-11, Block 610 providing for equal or better <br /> design treatment as compared to the Amended Development Agreement; and <br /> 12. After holding a public hearing on the request, the Planning Commission adopted a <br /> resolution recommending nullifying the Amended Development Agreement and changes <br /> to Ordinance No. 2847-05 but retaining the adopted Comprehensive Plan land use <br /> designation; and <br /> 13. The City Council held a public hearing and considered testimony at the public hearing <br /> related to the proposed ordinance amendment and repeal of the Amended Development <br /> Agreement; and <br /> WHEREAS, the City Council concludes the following: <br /> 1. The proposed action is consistent with the applicable provisions of the Everett <br /> Comprehensive Plan; and <br /> 2. The proposed action bears a substantial relation to the public health, safety and welfare; <br /> and <br /> 3. The proposed action promotes the best long-term interests of the Everett community; and <br /> 4. By virtue of adopting this Ordinance, the Property is rezoned R-5 without Development <br /> Agreement, the Amended Development Agreement is nullified and the existing <br /> Comprehensive Plan land use designation for the Property is affirmed; and <br /> 5. All future development within the subject rezone area will be governed by the <br /> development and design standards of EMC Chapter 19.33G. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Zoning amended. The zoning map of the City of Everett is hereby amended <br /> from "R-5 with Development Agreement to "R-5" for the Property, which is legally described as <br /> follows and is shown graphically in"Exhibit A." <br /> Legal Description of Rezone Area: See attached"Exhibit B" <br /> Section 2. Ordinance No. 2847-05 superseded with regard to R-5 zoning with <br /> Development Agreement. By virtue of Section 1, the Property is now rezoned R-5 without <br /> 2 <br />
