• _
PLANNING DIRECTOR CERTIFICATION
NON-CONFORMING USE #04-001
Applicant: Tuan Phan, 16314 22nd Ave W, Lynnwood, WA 98037
Description of property structure(s) and parcel(s) being certified:
Site Address: 1713 17 Street
Legal Description: Plat of Everett Div L BLK 339 - Lots 17 & 18 Less E 72 Feet
Tax Identification Number: 00438033901701
Zoning: R-2, Single Family Detached Medium Density
Description of Non-conformities: The site is developed with a duplex structure.
According to Snohomish County Assessor's records the subject building was
constructed prior to December 1, 1956.
ft appears that the structure originally housed a commercial barbershop and a residential
unit. The site has moved toward conformance with the conversion of the commercial
space into a dwelling unit since comrrercial uses are not permitted within a single-family
residential zone. The site has lost all nonconforming status with regards to commercial
uses; two residential units is the maximum density this site may achieve.
The site also faiis to meet the code required four off street parking stalls. A garage door
is present on the northwest corner of the building, and appears to provide one on site
parking stall.
Decision: I hereby find that the use for the above structure is recognized as legal non-
conforming and meets the City of Everett Zoning Code in effect at the time of
construction. This certification is subject to revocation if it is found that the information
upon which this decision was based is erroneous. The applicant is still responsible for
determining whether there are any additional City, State, or Federal permit requirements
for any proposed building construction or remodel o ite.
January 23, 2004
Paul A. Ro rts, irector
This is an administrative decision that may be appealed to the City's Land Use Hearing
Ecaminer. An appeal must be filed with the City within 14 days of the date of this notice.
If you have questions regarding this proposal or if you wish to file an appeal, please
contact Becky Fauver, City of Everett Planning Department, at (425) 257-7281.
S:1BFauver\NCB-NCU\U04-001 1713 17th Street.doc
