3. An emergency does exist to protect the public health, safety, and welfare; <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Findings of Fact <br /> The"Whereas"provisions above shall constitute Findings of Fact and are incorporated by <br /> reference as if fully set forth herein. <br /> Section 2. Moratorium <br /> A moratorium is hereby established on the establishment, location, operation,maintenance, or <br /> continuation of collective gardens,as referenced and defined in E2SSB 5073 § 403, as a <br /> principal land use or an accessory use to any existing use. Establishing, locating, operating, <br /> maintaining, or continuing such use is prohibited during the moratorium. No collective garden <br /> applications for building permits, land use applications,or other land use or development permits <br /> or approvals, or any business license or registration shall be accepted during the effective period <br /> of this moratorium,no collective garden applications shall be processed during the effective <br /> period of this moratorium, and no permits, licenses,or approvals for collective gardens shall be <br /> issued or granted during the effective period of this moratorium. For purposes of this Ordinance, <br /> "collective gardens"shall have the same meaning as that term is referenced and defined in <br /> E2SSB 5073 § 403. <br /> Section 3. Work Plan <br /> Staff is hereby directed to implement the following work plan during the interim period. Staff is <br /> directed to review existing laws and regulations applicable to medical uses of cannabis and <br /> collective gardens and to monitor the pending dispute between state and federal law enforcement <br /> authorities regarding the legality of medical cannabis use under state and federal law. In addition, <br /> staff is hereby directed to review existing zoning,land use, and other regulations applicable <br /> within the City and to consider potential amendments to such regulations, after studying the <br /> potential impacts on the peace,health, safety, and welfare, to provide that the medical use of <br /> cannabis is permitted to the extent allowed by federal and state law and in a manner which <br /> assures adequate protection of the public health, safety, and welfare. Staff is encouraged to <br /> review and consider the experiences of other jurisdictions dealing with similar situations. <br /> Section 4. Term <br /> This moratorium shall terminate one year after passage unless earlier repealed or renewed <br /> according to law. <br /> Page 3 of 5 <br />
