D. Violation of subsection C.7 of this section shall constitute a gross misdemeanor, <br /> and may be punished by a fine and/or imprisonment up to the maximum fine <br /> amount and term of imprisonment set forth in EMC 10.07.080.A. Violation of <br /> any of the remaining provisions of subsection C of this section shall constitute a <br /> misdemeanor, and may be punished by a fine not to exceed one thousand dollars, <br /> or imprisonment not to exceed ninety days, or both such fine and imprisonment. <br /> Section 10: General duty. <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety and <br /> welfare of the general public and not to create or otherwise establish or designate any particular <br /> class or group of persons who will or should be especially protected or benefited by the terms of <br /> this ordinance. It is the specific intent of this ordinance that no provision nor any term used in <br /> this ordinance is intended to impose any duty whatsoever upon the city or any of its officers or <br /> employees. Nothing contained in this ordinance is intended nor shall be construed to create or <br /> form the basis of any liability on the part of the city, or its officers, employees or agents, for any <br /> injury or damage resulting from any action or inaction on the part of the city related in any <br /> manner to the enforcement of this ordinance by its officers, employees or agents. <br /> Section 11: Savings. <br /> The enactment of this ordinance shall not affect any case, proceeding, appeal or other matter <br /> currently pending in any court or before the City or in any way modify any obligation, right or <br /> liability, civil or criminal, which may exist by virtue of any of the ordinances herein amended. <br /> Section 12: Severability. <br /> If any section, subsection, sentence, clause, phrase or word of this ordinance should be held to be <br /> invalid or unconstitutional by a court of competent jurisdiction, such invalidity or <br /> unconstitutionality thereof shall not affect the validity or constitutionality of any other section, <br /> subsection, sentence, clause,phrase or word of this ordinance. <br /> Section 13: Corrections. The City Clerk and the codifiers of this ordinance are authorized to <br /> make necessary corrections to this ordinance including, but not limited to, <br /> The correction of scrivener's/clerical errors, references, ordinance numbering, section/subsection <br /> numbers and any references thereto. <br /> Section 14: Ordinance Reference. This Ordinance amends Section 9 of Ordinance No. 1145- <br /> 85 (EMC 10.04.080); Section 19 of Ordinance No. 1041-84 (EMC 16.60.190); Section 2 of <br /> Ordinance No. 3074-08 (EMC 10.62.020); Section 3 of Ordinance No. 3074-08 (EMC <br /> 10.62.030); Section 2 of Ordinance No. 3134-09 (EMC 46.04.060); Section 5 of Ordinance No. <br /> 1228-86, as amended by Section 4 of Ordinance No. 2393-99 (EMC 6.08.050); Section 16 of <br /> Ordinance No. 3135-09 (EMC 12.02.133); Section 29 of Ordinance No. 2442-00, as amended by <br /> Section 1 of Ordinance No. 3059-08 (EMC 9.06.208); and Section 7 of Ordinance No. 1810-91, <br /> as amended by Section 1 of Ordinance No. 2091-95, Section 6 of Ordinance No. 2394-99 and <br /> 14 <br />
