C. Whenever the performance of any act is prohibited by any ordinance, and no penalty for <br /> the violation of such ordinance is imposed, the committing of such act shall be a <br /> misdemeanor. <br /> Is hereby amended to read as follows: <br /> Offense—Penalties. <br /> Unless otherwise provided,the penalties for offenses shall be as follows: <br /> A. A gross misdemeanor may be punished by a fine not to exceed five thousand dollars or <br /> imprisonment not to exceed three hundred-sixty-four (364) days, or by both such <br /> imprisonment and fine. <br /> B. A misdemeanor may be punished by a fine not to exceed one thousand dollars, or <br /> imprisonment not to exceed ninety (90) days, or by both such imprisonment and fine. <br /> C. It is unlawful for any person to paint, spray, chalk, etch, draw, or otherwise apply graffiti <br /> on any natural or manmade surface on public or, without written permission of the owner <br /> or occupant, privately owned buildings, signs, walls, fences, permanent structures, <br /> property, or places or other surfaces within the city. <br /> 2 <br />
