SECTION 12: Buffers for Urban Conservancy Wetlands in Marshland <br /> Regulation 25 in Section 3.9 of the Shoreline Master Program, Exhibit A to Ordinance No. 2600- <br /> 02, as amended, which was codified in EMC I9.33D.090.A.25, and which currently reads: <br /> Buffers shall not be reduced below that required by EMC 19.37.100.A. for the Urban <br /> Conservancy designated wetlands in the Marshland area, or the wetlands in 1997 SEWIP AUs <br /> 10, 8, and 20 on Smith Island, except when the proposal includes significant actions that would <br /> restore salmonid rearing functions, such as removing dikes, improving channel connections, and <br /> removing fill to create tidal marsh, and except where existing improvements such as the railroad <br /> effectively limit the buffers in some areas. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Buffers shall not be reduced below that required by EMC 19.37.100.A. for the Urban <br /> Conservancy designated wetlands in the Marshland area except when the proposal includes <br /> significant actions that would restore salmonid rearing functions, such as removing dikes, <br /> improving channel connections, and removing fill to create tidal marsh, and except where <br /> existing improvements such as the railroad effectively limit the buffers in some areas. <br /> SECTION 13: Stormwater Facilities in Buffers <br /> Regulation 26 in Section 3.9 of the Shoreline Master Program, Exhibit A to Ordinance No. 2600- <br /> 02, as amended, which was codified in EMC 19.33D.090.A.26,which currently reads: <br /> Stormwater facilities such as wetponds are prohibited in buffers for Category 1 streams and <br /> wetlands and the wetlands in 1997 SEWIP AUs 8, 10, and 20 on Smith Island and the Urban <br /> Conservancy designated wetlands in the Marshland area. In situations where stormwater <br /> facilities are placed in buffers on Category 2, 3, and 4 wetlands and streams, there shall be no <br /> significant loss of buffer functions. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Stormwater facilities are prohibited in Category 1 stream and wetland buffers. In lower rated <br /> wetlands and streams, stormwater management facilities, are permitted only within the outer <br /> twenty-five percent (25%) of the buffer, provided that: <br /> i. The buffer area has been previously substantially and legally altered and is degraded as <br /> defined by PDI 01-005; <br /> ii. Native vegetation and soils at the site should be protected and low impact development <br /> techniques should be used to promote infiltration of stormwater at the source. <br /> Stormwater facilities shall be integrated into the wetland buffer as a natural drainage <br /> system. The slopes and all areas that are disturbed shall be planted with native vegetation <br /> consistent with a buffer enhancement/mitigation plan. Above ground concrete walls and <br /> structures are not permitted. Below grade structures may be permitted only if it can be <br /> shown to the satisfaction of the planning director that the use of such materials fits with <br /> • <br /> 27 <br />
