3 <br /> as amended by Subsection A of Section 1 or Ordinance No. 3028-07, as amended <br /> by Subsection A of Section 1 of Ordinance No. 3388-14 (EMC 46.10.010.A), which <br /> reads as follows: <br /> Officers authorized to remove certain vehicles. <br /> A. Impoundments. Whenever the driver of a vehicle is arrested for a violation of <br /> RCW 46.61.502 or 46.61 .504, the vehicle is subject to impoundment at the direction <br /> of a law enforcement officer. In addition, a police officer or parking enforcement <br /> officer may take custody of a vehicle and provide for its prompt removal to a place <br /> of safety under any of the following circumstances: <br /> 1. Whenever any police officer or parking enforcement officer finds a vehicle <br /> stopped or parked upon any roadway or alley, whether attended or unattended, the <br /> officer is authorized to provide for the removal of the vehicle or require the driver or <br /> other person in charge of the vehicle to move the vehicle to a position off the <br /> roadway or alley or away from the main traveled portion thereof; <br /> 2. . Whenever any police officer or parking enforcement officer finds a <br /> vehicle unattended upon any highway where the vehicle constitutes an obstruction <br /> to traffic or jeopardizes public safety; <br /> 3. Whenever a police officer finds an unattended vehicle at the scene of an <br /> accident or when the driver of any vehicle involved in an accident is physically or <br /> mentally incapable, or too intoxicated, to decide upon steps to be taken to protect <br /> his or her property; <br /> 4. Whenever the driver of a vehicle is arrested and taken into custody by a <br /> police officer; <br /> 5. Whenever a police officer discovers a vehicle which he determines to be a <br /> stolen vehicle <br /> 6. Whenever any police officer or parking enforcement officer finds a vehicle <br /> standing or parked in a designated towaway zone; <br /> 7. Whenever a police officer or parking enforcement officer finds a vehicle <br /> without a special license plate, placard, or decal indicating that the vehicle is being <br /> used to transport a disabled person under RCW 46.16.381 parked in a stall or <br /> space that is clearly and conspicuously marked, as described in the city's parking <br /> ordinance, as a parking space or stall for a disabled person, on private property <br /> without charge or on public property; <br /> 8. Whenever any police officer or parking enforcement officer finds a vehicle <br /> standing or parked in a fire lane or within fifteen feet of any fire hydrant whether on <br /> public or private property; <br /> Page 1222 of 25 <br />
