B. "Civil infraction"means an offense that is established by City ordinance and punishable by <br /> the imposition of a civil fine. A civil infraction proceeding is initiated by the issuance, <br /> service, and filing of a notice of civil infraction. A notice of civil infraction may be issued by <br /> a person designated by the parks and recreation director to enforce the park code when the <br /> civil infraction occurs in that person's presence. A court may issue a notice of civil infraction <br /> if a person designated by the parks and recreation director to enforce the park code files with <br /> the court a written statement that the civil infraction was committed in his/her presence or that <br /> he/she has reasonable cause to believe that a civil infraction was committed. Procedural rules <br /> for civil infractions are set forth in the Infraction Rules for Courts of Limited Jurisdiction. <br /> C. A"gross misdemeanor" is a criminal offense that may be punished by a fine not to exceed <br /> five thousand dollars or imprisonment not to exceed three hundred sixty-four days, or by both <br /> such imprisonment and fine. A"misdemeanor" is a criminal offense that may be punished by <br /> a fine not to exceed one thousand dollars, or imprisonment not to exceed ninety days, or by <br /> both such imprisonment and fine. Whenever the performance of any act is prohibited by any <br /> ordinance, and no penalty for the violation of such ordinance is imposed, the committing of <br /> such act shall be a misdemeanor. <br /> D. "Park"means and includes any and all city parks, public squares,park drives,the <br /> Wetmore Theatre Plaza and any other plaza hereinafter deemed to be a"park", parkways, <br /> boulevards, golf courses,park museums, zoos, bathing beaches, and play and recreation <br /> grounds that have been established as parks. <br /> Section 2: Sections 1 and 4 (part) of Ordinance 1615-89, as amended by Section 12 of Ordinance <br /> 2442-00 (EMC 9.06.034), which reads as follows: <br /> Parks director responsibility and authority. <br /> A. It shall be the responsibility of the parks director of the city to enforce all provisions of this <br /> chapter, the city park code, including park rules and regulations adopted by the park commission <br /> or the parks director and including the prohibition against camping in any park, Section <br /> 8.56.010(A) of this code. <br /> B. The parks director and his/her designees shall be empowered to exercise the authority of <br /> peace officers to the extent necessary to enforce the city park code, which power shall include <br /> issuance of citations. <br /> C. The parks director and his/her designees shall be empowered to exercise the authority of <br /> peace officers to the extent necessary to enforce the city parking laws (Chapter 46.28 of this <br /> code) within one thousand feet of any city park, which power shall include issuance of citations. <br /> 2 <br />
