B. Subsection A of this section shall not apply to or affect the following: The possession, by <br /> a person twenty-one years of age or older, of useable marijuana or marijuana-infused products in <br /> amounts that do not exceed those set forth in Subsection C of this section. <br /> C. The amounts of useable marijuana or marijuana-infused products applicable to this section <br /> are: <br /> 1. One ounce of useable marijuana; <br /> 2. Sixteen ounces of marijuana-infused product in solid form; <br /> 3. Seventy-two ounces of marijuana-infused product in liquid form. <br /> D. The terms "marijuana," "useable marijuana,"and"marijuana-infused product" shall be <br /> defined as set forth in Chapter 10.02 of the Everett Municipal Code. <br /> Section 32: Section 2 of Ordinance 2442-00 (EMC 9.06.205), which reads as follows: <br /> Possessing or obtaining tobacco by minor—Refusal to give information. <br /> A. A person under the age of eighteen who possesses or obtains, or attempts to obtain <br /> cigarettes or tobacco products in a city park commits a civil infraction and is subject to a fine of <br /> fifty dollars, not including any statutory assessments, or participation in up to four hours of <br /> community service, or both. The court may also require participation in a smoking cessation <br /> program. <br /> B. Any person requested to identify himself or herself to a park ranger pursuant to an <br /> investigation of a violation of this section has a duty to identify himself or herself and give his or <br /> her current address. Refusal to give information to a park ranger is a misdemeanor, and may be <br /> punished by a fine not to exceed one thousand dollars, or imprisonment in jail not to exceed <br /> ninety days, or by both such imprisonment and fine. <br /> Is hereby amended to read as follows: <br /> Possessing or obtaining tobacco by minor. <br /> A. It is unlawful for any person under the age of eighteen to possess or obtain, or attempt to <br /> obtain, cigarettes or tobacco products in a city park. Violation of any of the provisions of this <br /> section constitutes a civil infraction, and may be punished by a penalty of not more than two <br /> hundred fifty dollars. In addition to or in lieu of the monetary penalty, the court may order <br /> participation in up to four hours of community service or participation in a smoking cessation <br /> program, or both. <br /> B. Any person requested to identify himself or herself to a park ranger pursuant to an <br /> investigation of a violation of this section has a duty to identify himself or herself and give his or <br /> 23 <br />
