Resolution No. 6066 <br /> A RESOLUTION Declaring an Emergency <br /> • <br /> Regarding the Repair of the Smith Island Levee <br /> WHEREAS, the City of Everett owns and operates The City of Everett Wastewater Pollution <br /> Control Facility located on Smith Island, which is protected along the south end of the <br /> property by a dike along the Snohomish River; <br /> WHEREAS, this dike not only protects the Everett Water Pollution Control Facility, it <br /> protects Interstate 5 and public and private property north of the Everett Water Pollution <br /> Control Facility; <br /> WHEREAS, The Smith Island dike has experienced a 50 foot long scarp that weakens the <br /> dike along the river to the point that imminent repairs are necessary; <br /> WHEREAS,the City of Everett Public Works needs to repair the damage to the dike prior to <br /> this years flood season (Snohomish County considers the second week of November the <br /> beginning of the flood season); <br /> WHEREAS, the City of Everett Public Works Department has made application for permits <br /> to do repair work on the damaged dike and targeted the low tides of this weekend to perform <br /> the work as these are the last low tides prior to flood season; <br /> WHEREAS,the City of Everett Public Works is waiting final permit authorization, but may <br /> not receive in time to perform the work during the target low tides of this weekend, <br /> WHEREAS, further dike damage could cause a failure that could result in disruption of the <br /> service of the Everett Water Pollution Control Facility, damage to the plant or ponds affecting <br /> health and sanitation, and possibly a direct discharge of untreated wastewater, which may <br /> negatively impact the environment; and <br /> WHEREAS, immediate action is needed to restore and preserve the dike structure to protect <br /> public health, life,property and the environment and this essential public facility; <br /> NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF EVERETT that: <br /> 1. Council declares an emergency exists because: <br /> a. Council finds that unforeseen circumstances beyond the control of the City <br /> present a real, immediate threat to the proper performance of the essential <br />
