Ted Budden <br />From: Ted Budden <br />Sent: Monday, August 27, 2012 9:45 AM <br />To: Kevin Fagerstrom <br />Cc: Tony Lee; Jeff Heilman <br />Subject: 3406 Wetmore Ave. <br />Kevin, <br />I received a concern from the city's utility billing division concerning a possible unlawful "MIL" apartment at 3406 <br />Wetmore. <br />I contacted the new owner and was able to determine from the conversation and my prior research that the apartment <br />in question does indeed exist and has been created without the required approvals. <br />The current owner has just purchased the property without knowledge of the unlawful status. He agreed to allow our <br />access to view the unauthorized apartment. <br />Here is an outline of our findings and observations. <br />1. The property is identified in tax records and in city records as a single family residence. <br />2. The building has been altered to include a cellar type apartment beneath the existing SFR. <br />3. These alterations were performed without required permits and approvals. <br />4. The basement apartment has extremely low headroom and is in violation of adopted codes. <br />5. Electrical, Plumbing, Mechanical, and Building components have been installed. Many of the observable features <br />of these construction elements have obvious code deficiencies and violations. <br />6. The basement apartment as I have stated, is Unlawful by Code standards. It also has built in defects that create <br />conditions that are defined by code as Dangerous, such as Inadequate egress, Unsafe equipment, Inadequate <br />fire resistive construction, etc. <br />7. The structure is vacant at this time and should remain so until the code violations and safety issues have been <br />resolved. <br />8. The owner is willing to cooperate with this scenario he has serious case of "buyers remorse" and stated that he <br />intends to pursue damages from the seller (s). <br />9. Please start enforcement action on this property ASAP. <br />10.
