• <br />�vITNESSETH <br />WHEREA.S, the undersigned is (are) the owner(s} of or has (have) a <br />substantial interest in the real property legally described above <br />("Property„}; and <br />WHEREAS, the Grantee/Covenantee, the City of Everett ("City") has <br />a substantial interest in the effective and safe �ise of lands <br />within its borders, and in the health, safety and welfare of its <br />ci�izens; and <br />' WHEREAS, the Owner(s) have applied for permission to place, <br />construct and maintain a secondary kitchen(s) within a si.ngle <br />family dwelling uni� or resident; and <br />WHEREAS, before the City will issue any permit or approval for a <br />secondary kitchen to be placed, constructed or maintained within <br />a single family dwellzng unit on the Property, this Covenant must <br />be signed, acknowledged and recorded in the records of Snohomish <br />County as a restrictive covenant, restricting the use and <br />enjoyment of the Property by placing conditions on the permiss.ion <br />to place, construct or maintain a secondary kitchen; and <br />WHEREAS, this Covenant concerns the Grantor/Covenantor's use, <br />occupation, enjoyment of the Praperty and benefits the City as <br />Grantee/Covenantee; and <br />WHEREAS, this Covenant is intended to bind successors and assigns <br />and run with the land; <br />NOW, �HEREFORE, Owner (s) agrea (s) to ab�.de by restra.cti.ons on <br />ocaupation, use, and enjoyment ot the Property as follows: <br />1.Owner(s) agree that the single family residence shall not be <br />used for any purpose which is not in full compliance wi.th the <br />conditions o� this Covenant and with all Cit.y o� Everett zoning <br />and building regulations. . <br />2.Otaner{s) agree that the internal connection(s) between al.l <br />living spaces caithin the single family dwelling shall remain and <br />meet City of Everett building regulations. <br />3.Owner{s) agree that the occupants of the sing].e family dwelling <br />shall meet the definition of family as defined in the City of <br />Evere�t zoning code.
