SNOHOMISH COUNTY COUNCIL Snohomish County, Washington MOTION NO. 14-430 AUTHORIZING THE COUNTY EXECUTIVE TO SIGN DOCUMENTS RELATED TO THE VACATION OF PROPERTY LOCATED IN THE CITY OF EVERETT FOR THE NEW COUNTY COURTHOUSE PROJECT WHEREAS, on November 25, 2013 the Snohomish County Council authorized the design and construction of a new county courthouse (the "Project") on property at the northwest corner of the Wall Street/Oakes Avenue intersection; and WHEREAS, in order to construct the Project, the alley portions of Block 685, Plat of Everett and Block 685, Everett Land Company's First Addition to Everett, all located in the City of Everett ("Alley") as more particularly described in section II of the Petition for Vacation, attached hereto as Exhibit "A" must be vacated; and WHEREAS, upon receipt of a Petition for Vacation from two-thirds of owners with an interest in real estate abutting the alley, the City of Everett will fix a time and date when the Petition for Vacation will be heard and determined; and WHEREAS, if the City of Everett approves the vacation, it will require compensation for the fair market value of the Alley; and WHEREAS, the Project team recommends that the County Council authorize the Snohomish County Executive, or his designee, to sign the Petition for Vacation and any document necessary to vacate the Alley, including payment of the Ally's fair market value, or other dedication in lieu of compensation; NOW, THEREFORE, ON MOTION, the Snohomish County Council authorizes the Executive, or his designee, to sign the attached Petition for Vacation and any documents necessary to vacate the Alley, including payment of the Alley's fair market value, or other dedication in lieu of compensation.
