CITY <br /> LEASE AGREEMENT <br /> This Lease is made this)IStday of /V OV etyibev , 2016,between the City of Everett, a <br /> municipal corporation under the laws of the State of Washington,hereinafter referred to as <br /> the "City or Lessor", and Snohomish Health District, hereinafter referred to as "SHD or Lessee". <br /> WITNESS <br /> 1. PREMISES. The Lessor does hereby lease to Lessee, and Lessee does hereby lease <br /> from Lessor, 20 parking stalls along the western fence line of those certain premises commonly <br /> known as W. Marine View Drive Parking Lot, (hereinafter called"Premises"),being located at <br /> the northeast corner of West Marine View Drive and 26th Street, Everett, Washington, 98201 and <br /> legally described as: <br /> Lots 5 thru 16, Block 558, Plat of Everett Div. G, according to the plat thereof recorded in <br /> Volume 4 of Plats,page 41, less right of way to the City of Everett per Statutory Warranty <br /> Deed recorded under file number 9012030271,records of the Auditor, of the County of <br /> Snohomish, State of Washington. <br /> 2. TERM. The initial term of this lease shall commence on November 14, 2016, and <br /> continue on a month to month basis. Except as otherwise provided in this Agreement, either <br /> party may terminate this Agreement upon thirty(30) days written notification. If this Agreement <br /> is so terminated,the terminating party shall be liable only for performance in accordance with <br /> the terms of this Agreement for performance rendered prior to the effective date of termination. <br /> 3. RENT. Lessee leases said Premises for said period and agrees to pay a monthly rental <br /> in the amount of$800.00 on or before the fifteenth day of each month during the term of this <br /> lease to: <br /> Treasurer <br /> City of Everett <br /> 2930 Wetmore <br /> Everett, WA 98201 <br /> or such other place as the Lessor may from time to time designate in writing. If any rent is, at <br /> any time, five (5) or more days past due, Lessee will be charged a late charge equal to ten(10) <br /> percent of the past due rental amount. All rent payments must be made without deduction or <br /> offset. <br /> 4. USE. SHD may use and occupy said Premises for vehicle parking only Monday thru <br /> Sunday twenty four hours per day, seven days per week. City and its assigns shall retain use of <br /> the balance of the Premises at all times. Lessee shall be responsible for securing the Premises <br /> during the term of this lease. Lessee agrees that its use of the Premises and occupancy thereof <br /> Lessee shall comply with the laws,rules and regulations of the governments of the United States, <br /> State of Washington, Snohomish County and City of Everett. Lessee agrees to maintain the <br /> Premises in good condition and repair throughout the term of the lease. Upon termination of the <br /> lease, Lessee shall quit and surrender the Premises in as good a state and condition as reasonable <br /> use and wear and tear thereof permit, damage by the elements or other actions not caused by <br /> Lessee or its employees, agents, customers or invitees excepted. <br />
