Ted Budden
From: Ted Budden
Sent: Thursday, July 11, 2013 9:03 AM
To: Kevin Fagerstrom
Cc: Tony Lee; Paul McKee; Meg Haley
Subject: Accessible Parking Spaces. Alterations/Elimination Without Permits.
Hi Kevin, Per prior discussions.
We have two separate multi-family properties that have had construction activity performed without permits to the
parking facilities that are provided to the tenants that reside there.
These alterations have included the reduction of and re-location of required accessible parking spaces.
These alterations were performed in violation of numerous adopted Codes. (see prior emails from plans examiner Meg
Haley for the appticable code sections and specific detaifs).
To simplify the Enforcement actions I suggest we use only the IPMC Code section 108.1.4 Unlawful Structure. Here is
my logic.
1. The parking areas are defined by the IPMC as a Structure. ("That which is built or constructed")
2. The parking areas are now Unlawful Structures because they have been ("altered contrary to law")
3. The IPMC code uses more appropriate language that addresses the structures and not the specific inclividuals who
may have performed the violations.
4. Permits and approvals are required as outlined in Ms. Haley's compilations.
We request and require your Enforcement assistance to pursue compliance through the permitting and inspection
process and to establish a timeline for this.
The location of these properties and violations are: 805 1122h St SE. (an 11 building apartment complex) and 12115 19tn
Ave SE. (a 204 unit apartment complex)
Please initiate Enforcement action as your schedule allows. Should you need additional information please let me know.
Thank you.
Ted Budden
