We were able to
locate the drain hose as indicated in the complaint but were unable to visualize the origin of the hose due to right of
entry. We witnessed that there was a continual flow with regular, intermittent higher discharge — equivalent to the
discharge hose originating from a pump that was working. We further noticed that the discharge, while continuing
down the private-shared driveway, did not end up at the public way or over any sidewalk.
The violation is in the discharge and is being forwarded on to Code Enforcement to be included within a Violation
Citation.
Tony Lee
Building Official
From: archbrianr@comcast.net fmailto:archbrianr@comcast.net]
Sent: Monday, April 11, 2016 2:17 PM
To: Kevin Fagerstrom
Cc: jautler@denomillikan.com
Subject: Illegal subsoil water discharge at 1336 Madrona Ave.
Good afternoon Kevin,
I did a little research into the Everett Building Code and found the following information. It
shows conclusively that Mudaliar cannot lawfully discharge subsoil water in the manner that
he is doing under the existing statutes. If the City goes so far as to grant Mudaliar variances to
these code requirements so as to approve his method of discharge, my wife and I will naturally
have to fight it.
Please refer to info below. I have highlighted important portions and added comments in reca.
