� <br />CITY OF EVERETT <br />PLANNING DIR�CTOR DECISIOI�t <br />Use Permii with Conditions - USE #14-001 <br />Deceinber S, 2014 <br />Applicant: Putple Haze Collective LLC <br />Jesse Wofford <br />6012 Beverly Lane #B <br />Everett, WA 98203 <br />Project Location: 4218 Rucker Avenue <br />Everett, WA 9$201 <br />Project Description: Locate a marijuana retailer at 4218 Rucker Avenue. <br />Zoning: �-1 MtJO, Evergreen Way Mixed Use Overlay <br />Background: On November 24, 2014 the Washington State Liquor Control Board issued a <br />marijuana retailer license to the applicant, Pur��le Haze Collective LLC. The Applicant then <br />submitted a business license application to the City of Everett. In review of the business license <br />application, the Planning Departinent determined that a Use Peimit was required for the property. A <br />Use Permit application was submitted by the Applicant on December 2, 2014. <br />Marijuana retailers may operate in the City of Everett ptusuant to state law, Washington State <br />Liquor Control Board regulations and local restrictions. <br />Decision: Tlie Planning Director APPR�VES a marijuana retailer at 4218 Rucker Avenue, with <br />the follov��ing conditions below. All conditions must be met i�rior to mariivaua retailer <br />onerations. The city shall retain the right to revoke a pei7nit issued under tl�is section that fails to <br />comply with any conditions of approval, or which operates in a manner inconsistent with <br />representations made in the application, pursuant to Chapter 1.20. <br />Conditious of Annroval: <br />1) The marijuana retail operation must comply with all state and local rcgulations. Any violations of <br />local regulations are subject to enforcement tmder the provisions of Chapter 1.20 of the Everett <br />Municipal Code or tluough action of the City Attorney seeking injunctive or other civil relief in any <br />court of competent jurisdiction. <br />2) At a minimun�, six paved off-street parking stalls are required and shall be completed prior to <br />business operations. A Public Works pennit, inspections and final approval of the permit is required <br />for the parking improvements. Surfacing, layout, striping, drainage, compact parking stalls, <br />accessible parking stalls, parking stall sizes, aisle width and other construction details shall be in <br />accordance with the coustruction standards of the city engineer. . <br />3) This approval is limited to marijuana retail sales and no activity for marijuana production and/or <br />processing are allowed. <br />4) This approval shall not be construed as precedent settiug for any other property or use. <br />Page 1 of 2 <br />i ' S � 14-001 <br />
