The Premises shall be used by the Depaitinent of Employment Security and/or other state agencies <br /> for the following purpose(s): offices ("Permitted Use") and for no other purpose without the prior written consent of <br /> Lessor,which consent shall not be unreasonably withheld unless Lessor determines that any proposed use is either(i) <br /> inconsistent with the maintenance and operation of the Building as an office building. or (ii) inconsistent with the <br /> conditions, covenants, restrictions and any reasonable Rules and Regulations to be established applicable to the <br /> Building. No act shall be done in or about the Premises that is unlawful. Lessee shall not commit any act that will <br /> increase the then existing rate of insurance (primary or excess) on the Building without Lessor's consent. Lessee <br /> shall promptly pay upon demand the amount of the increase in insurance caused by such act or acts done by Lessee. <br /> Lessee shall not commit or allow to be committed any waste upon the Premises, or any public or private nuisance or <br /> other act which disturbs the quiet enjoyment of any other tenant in the Building. Without the written consent of <br /> Lessor, Lessee shall not use any apparatus, machinery or device in or about the Premises that will cause any <br /> substantial noise, vibration or fumes. Lessee shall comply with all laws relating to its use or occupancy of the <br /> Premises and shall observe such reasonable rules and regulations (not inconsistent with the terms of this Lease) as <br /> may be adopted and made available to Lessee by Lessor from time to time for the safety, care and cleanliness of the <br /> Premises or the Building, and for the preservation of good order therein. <br /> TERM <br /> 4. TO HAVE AND TO HOLD the Premises with their appurtenances for the term beginning July 1, <br /> 2002 and ending June 30, 2007. <br /> 4A. In the event the leased Premises are substantially completed and an occupancy permit is issued and <br /> Lessee takes occupancy prior to the commencement date,rent shall be prorated to the actual date of occupancy. <br /> RENTAL RATE <br /> 5. The Lessee shall pay rent to the Lessor for the Premises at the following rate: <br /> Twenty Five Thousand One Hundred Sixty-six Dollars and Seventeen Cents: $25,166.17 per month <br /> Payment shall be made at the end of each month upon submission of properly executed vouchers. Payments shall be <br /> made to Lessor in the form attached as Exhibit B. Upon receipt of the properly executed voucher, payments will be <br /> made within ten(10)business days following the end of the month. <br /> EXPENSES <br /> 6. During the term of this Lease, Lessor shall pay all real estate taxes, all property assessments, <br /> insurance, storm water, water, sewer, garbage collection, and maintenance and repair as described below, together <br /> with natural gas. electricity, elevator service, exterior and interior window washing, and janitor service -- to include <br /> window washing, restroom supplies, light bulbs, etc., as set forth in Exhibit "J" which is attached hereto and <br /> incorporated by reference. <br /> 6A. Lessee shall reimburse Lessor for its actual cost to provide janitorial service and separately <br /> metered electricity(or prorated electrical cost based on Lessee's BOMA rentable office space) on a monthly basis. <br /> Lessor shall submit a voucher (with a copy of all bills and proof of payment for which reimbursement is requested) <br /> to be paid by Lessee. <br /> 6B. Lessee shall reimburse Lessor for its prorata share of interior and exterior <br /> common area charges only. Lessor shall submit a quarterly voucher(with a copy of all bills and <br /> proof of payment for which reimbursement is requested) to be paid by Lessee for its prorata <br /> portion based upon Lessee's leased space. Lessee occupies approximately 13.727 square feet. <br /> 13 <br />
