4rr <br /> CITY OF EVERETT <br /> VIOLATIONS HEARING EXAMINER <br /> iity of Everett, a Washington ) <br /> Vlunicipal Corporation, ) Case No. 02-1254 <br /> ) <br /> Respondent, ) FINDINGS OF FACT, CONCLUSIONS <br /> ✓s. ) OF LAW AND ORDER OF THE HEARING <br /> ) EXAMINER <br /> Cobert Farmer ) <br /> ?302 Oakes Avenue ) <br /> Everett, Washington 98201 ) <br /> Appellant(s) ) <br /> This matter having come before the Violations Hearing Examiner on September 19, 2002, and the testimony of <br /> witnesses having been heard and all exhibits admitted into evidence having been considered, the Violations <br /> Hearing Examiner makes the following findings of fact and conclusions of law and order: <br /> Findings of Fact: <br /> 1. Robert Farmer is the owner of record of the property located at 2302 Oakes Avenue, Everett, <br /> Washington. <br /> 2. On August 19, 2002 and September 3, 2002, a refrigerator, coffee table, kitchen range and a bag <br /> of trash behind the house and overgrown grass and weeds on the south side of the house were <br /> observed on the property at 2302 Oakes Avenue, Everett, Washington. These same conditions <br /> were also observed on September 16,2002. <br /> 3. Robert Farmer was duly notified via posting of these conditions on August 30, 2002, was given <br /> the opportunity to correct these conditions; and, has had adequate notice of the opportunity to <br /> appear at the hearing to appeal the city's allegations. Robert Farmer did not appear at this <br /> hearing. <br /> Conclusions of Law <br /> 1. The conditions as described above constitute violations of Everett Municipal Code 8.20.020 (A) <br /> (B) (C) and (E). <br /> 2. The property owner to date has not corrected said violations. <br />
