Section 2. Franchise Extension. The City hereby extends the term of the current <br /> natural gas franchise held by Puget Sound Energy to and including October 31, 2003. This section <br /> supersedes any contrary provision of Ordinance 390-76 and Ordinance 2604-02. <br /> Section 3. Acceptance. Puget Sound Energy shall provide its written and <br /> acknowledged unconditional acceptance and promise to comply with all provisions, terms and <br /> conditions of the franchise agreement in Ordinance 390-76 during the extension period. <br /> Section4. Effective Date This ordinance and the franchise term extension provided <br /> for by Section 2 of this ordinance shall be effective upon the later to occur of: <br /> a. The expiration of thirty(30) days from the adoption of this ordinance; and <br /> b. The filing of Puget Sound Energy's acceptance and promise to comply as described in <br /> section three (3). <br /> If Puget Sound Energy does not file its acceptance and promise to comply as described in section <br /> three (3)within forty-five (45) days from the adoption of this ordinance, then this ordinance shall be <br /> null and void. <br /> Frank E.
