6 <br /> "'II b <br /> =Alb/lim..k. <br /> i•4 v o 1 I IB w A <br /> RESOLUTION NO. <br /> A RESOLUTION for the proposed vacation of a portion of <br /> 4th Street SE within the boundary of the Water Pollution <br /> Control Facility on Smith Island <br /> WHEREAS, RCW 35.79.010 provides in part for the City Council to initiate a right of <br /> way vacation by resolution, and <br /> WHEREAS, the City of Everett is the sole property owner abutting that portion of 4th <br /> Street SE described as follows: <br /> A strip of land 40 feet in width being 20 feet on each side of the following <br /> described centerline: <br /> BEGINNING at the south quarter corner of Section 16, Township 29 <br /> North, Range 5 East, W.M.; THENCE, West along the south line of said <br /> Section 16 a distance of 806.2 feet; THENCE, North perpendicular to said <br /> south line of said section a distance of 20 feet to the TRUE POINT OF <br /> BEGINNING of said centerline of 4th Street SE; THENCE, South <br /> 87°59"03" West a distance of 597.87 feet; THENCE, North 13°06"18" <br /> West a distance of 107.33 feet, more or less, to intersect the Interstate <br /> Highway Five right of way line, and the TERMINUS OF SAID <br /> CENTERLINE. <br /> and shown and delineated on the attached map; and <br /> WHEREAS, R.C.W. 35.79.010 further provides that City Council shall, by resolution, fix <br /> a time for public hearing on said matter; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF <br /> EVERETT that 4th Street SE is proposed to be vacated, and that a public hearing be set <br /> for April 23rd, 2003 at 8:30A.M. in the City Council Chambers, City Hall, to consider the <br /> proposed vacation of the right-of-way as herein described. <br /> Councilperson Introducing Resolution <br /> PASSED AND APPROVED this 2nd day of April, 2003. <br /> Council President <br />
