Many times the City is required by these other agencies to sign certifications. This is especially <br /> true in the context of grant agreements. These certifications usually certify that the City is in compliance <br /> with applicable laws and in compliance with the grant agreement. <br /> Over time,the number of certifications required of the City has significantly increased. They have <br /> also become more detailed and complex. For example, in some grant agreements, certifications are now <br /> required to accompany every City request to draw grant funds and must be signed by persons with authority <br /> to legally bind the City. <br /> By Charter(Section 4.14),the Mayor must sign 141 written contracts, bonds and instruments of <br /> every kind and description,"unless Council approves guidelines for signature by Chief Administrative <br /> Assistant or designated department heads. Because of the increasing number of required certifications from <br /> the City, and because the Mayor sometimes may not have personal knowledge of the specifics what is being <br /> certified,Mayor signature on all certifications is becoming more impractical. <br /> The purpose of this resolution is to establish guidelines for the delegation of certification signing to <br /> Chief Administrative Assistant or certain department heads. In particular,the resolution allows the Mayor to <br /> delegate certification signing to the following persons: <br /> (1) Chief Administrative Assistant <br /> (2) department head of the department most closely connected to the need for the certification <br /> (for example,the department head of the department receiving the grant funding requiring the certification) <br /> (3) department head most knowledgeable regarding the subject matter of the certification <br /> The specific procedures for how such delegation will administratively occur will be issued by the Mayor. <br /> The resolution is limited to certifications and does not change signing processes for anything else. <br /> RECOMMENDATION (Exact action requested of Council): <br /> Adopt resolution establishing written guidelines for the delegation of signing of certifications required by <br /> federal, state and other government agencies. 7 <br />
