. <br /> ORDINANCE NO. <br /> AN ORDINANCE providing for the vacation of a <br /> portion of Cady Road <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 5261 <br /> duly adopt and fix the 27th day of November, 2002 at 8:30A.M.,.as the date and time of <br /> public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said Resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly <br /> presented; and <br /> WHEREAS, the City Council finds it would not vacate the right-of- way if a utility <br /> easement could not be retained; and <br /> WHEREAS, the petitioners applied for said right of way vacation after the City of <br /> Everett's adoption of Resolution No. 5083 amending the compensation requirements <br /> for right of way vacations; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said <br /> right-of-way resolved to be vacated should be vacated pursuant to the terms and <br /> conditions of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described right-of-way: <br /> All that portion of the Southeast quarter of the Northwest quarter of Section 6, Township 28 North, Range <br /> 5 East, W.M., and of the Plat of Fairview Heights, according to the Plat thereof, recorded in Volume 11 of <br /> Plats, Page 56, Records of Snohomish County, State of Washington, described as follows: <br /> 13 <br />
