ALVENSLEBEN (collectively the "Owner") and OLYMPUS TERRACE SEWER DISTRICT, a municipal corporation of the State of Washington (the "District"). RECITALS The Board of Sewer Commissioners of the District operates a system of sewerage for collection and treatrnent of sanitary sewage in a portion of the District. The Owner is the owner of property located at 7901 - 40th Avenue West, Everett, Washington 98203, legally described in EXHIBIT A attached hereto and incorporated herein by this reference (the "Property"). The Property is located within the City of Everett and outside the District's service area. The City of Everett is unable to provide sewer service to the Property. Sewer service by the District to areas within Everett's sewer service area requires the consent of the City of Everett pursuant to Everett Ordinance No. 2647-02 (EMC Chapter 14.04). The District is constructing sewage collection lines pursuant to formation of Utility Local Improvement District No. 11 ("ULID No. 11"). The Property is adjacent to, but outside, the service area of ULID No. 1 I. The Owner desires to have the Property furnished with sewage collection and treatment service by the District. Subject to the terms and conditions contained herein, and the approval of the City of Everett, the District is willing to furnish the Property with sewage collection and treatment service. TERMS AND CONDITIONS IN CONSIDERATION OF the covenants provided herein, the parties hereto, for themselves, their assigns and successors in interest, agree as follows: 1.
