I <br /> 13 <br /> a. Transmit and receive radio signals on various frequencies; <br /> b. Furnish, install and use in, upon and under and remove from the Site such wires, <br /> equipment and other property of whatsoever kind and nature as Lessee deems <br /> necessary; <br /> c. Connect such wires and equipment to utility lines adjoining the Site; and <br /> d. Install a standby power generator for Lessee's exclusive use at a location on the <br /> Site acceptable to both parties. <br /> v. All work done by Lessee at the Site, including work on the Tower, shall be done <br /> in a lawful manner and in conformity with all applicable laws, ordinances and regulations. Use <br /> by Lessee of the Site and Tower shall not conflict with Lessor's and Third Party's use of the Site, <br /> Tower and related facilities. Lessee and Third Party both agree that their use of the Site and <br /> Tower shall not conflict with the use of the Site, Tower and related facilities of other users. <br /> Lessee shall label all antennas and equipment in a manner that provides readily visible ownership <br /> identification. <br /> vi. After receipt of written authorization by the Lessor and Third Party; Lessee is <br /> authorized to construct on the property; and Lessee has the right to prepare, maintain and alter <br /> the Site for Lessee's business operations and to install transmission lines, connecting antennas to <br /> the transmitters and receivers. <br /> vii. Lessee agrees that in the event there is any interference with Lessor's or Third <br /> Party's transmitters and/or receivers or in the event there is any interference with the transmitters <br /> and/or receivers of other lessees established at the Site prior to the date of this Lease, caused by <br /> Lessee's transmitter(s) and/or receiver(s), which is not remedied by Lessee within seventy-two <br /> (72) hours of verbal notification by Lessor or Third Party, Lessee agrees to cease using the <br /> equipment which is creating the interference (except for short tests necessary for the elimination <br /> of the interference) until the interference is eliminated. Provided, however, notwithstanding any <br /> language herein, Lessee agrees that in the event that Lessee's wireless communications facility, <br /> installation or equipment causes any interference with a public safety communications system(s) <br /> whether said system is existing, planned or yet to be constructed that is not remedied by Lessee <br /> within six (6) hours of verbal notification by the public safety communications system, Lessee <br /> agrees to cease using the facility or equipment which is creating the interference (except for short <br /> tests for the elimination of the interference when authorized by the public safety communications <br /> system) until the interference is eliminated to a standard and manner acceptable to the public <br /> safety communications system. <br /> 4. RENT: On the first day of each and every calendar month commencing on the <br /> first day of the first calendar month of the Initial Term, Lessee shall pay to the Lessor rent as <br /> follows: <br /> 84 <br /> Page 3 of 30 <br />
