/1Pr‘/° 1- Resolution No. 5743 A RESOLUTION Declaring an Emergency Regarding the Repair of the Southwest Sewer Interceptor WHEREAS, the City of Everett owns and operates the Southwest Sewer Interceptor ("Line") that conveys sewer to the Everett Wastewater Pollution Control Facility (EWPCF); WHEREAS, the average flow rate of this Line is 2.5 million gallons per day, which is a significant portion of the City's wastewater conveyance system; WHEREAS, the City provides potable wastewater treatment to approximately 140,000 residents of Snohomish County; WHEREAS, the utility needs to evaluate and develop a repair system for this Line; WHEREAS, the Leak was reported by the Port of Everett at 10:30 a.m., Sunday. After investigating the leak on this line, it was determined that a wood piling damaged the bottom of the pipe and was causing the leakage. WHEREAS, damage, rupture or conveyance of wastewater or failure of the Line would likely result in disruption of service of this facility, affecting health, sanitation, and would result in the discharge of wastewater, possibly negatively affecting the environment, WHEREAS, immediate action is required to preserve the public health and to protect life, property, the environment and this essential public function; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT that: 1. Council declares an emergency exists because: a. Council finds that unforeseen circumstances beyond the control of the City present a real, immediate threat to the proper performance of the essential function of conveying wastewater to the EWPCF to the citizens of Everett and the residents of Snohomish County;
