mimaa <br /> RESOLUTION NO. 5702 <br /> A RESOLUTION to authorize the Mayor to sign a Notice of Intent to apply to <br /> the Federal Energy Regulatory Commission for a new Jackson Project license and to <br /> approve a Pre-Application Document. <br /> WHEREAS, on June 6, 1961, the Public Utility District No. 1 of Snohomish <br /> County(the "District") and the City of Everett (the "City") were granted license No.2157 <br /> by the Federal Energy Regulatory Commission ("FERC") as co-licensees, for the <br /> construction and operation of combined water storage and electric power generation <br /> facilities known as the Jackson Hydroelectric Project (the"Project"); and <br /> WHEREAS, the license issued by FERC for Project construction and operation <br /> expires on May 31, 2011, and City Council finds that the City has a continuing need for <br /> water supplied by the Project to meet the requirements of its water system customers; and <br /> WHEREAS, the City Council has the power and authority to approve and direct <br /> the filing of formal documents with FERC, such as Notice of Intent, Pre-Application <br /> Document or Application for Hydropower Project License, for the purpose of renewing <br /> and extending the license of the Jackson Project and the power and authority to direct the <br /> Mayor to sign such documents and to cause their timely filing; and <br /> WHEREAS, the Federal Power Act and applicable regulations in 18 CFR Part 5 <br /> require that potential license applicants file with the FERC at least 5 years but not more <br /> than 5.5 years before expiration of a current license 1) a Notice of Intent stating an <br /> unequivocal intention to file an application for a new license; and 2) a Pre-Application <br /> Document containing existing project information relevant to the project proposal which <br /> 1 <br />
