/1(41%b /=.1 RESOLUTION No. 5691 A RESOLUTION APPOINTING AN AUTHORIZED REPRESENTATIVE TO APPLY FOR FEDERAL PRESCRIPTION DRUG SUBSIDIES WHEREAS, the City of Everett sponsors and maintains a group health program (hereinafter referred to as the"Plan"), under which eligible individuals are able to obtain certain prescription drug benefits; and WHEREAS, the new Retiree Drug Subsidy program(the"Drug Subsidy Program"), created pursuant to the Medicare Modernization Act of 2003 and administered by the Center for Medicare and Medicaid Services (CMS),provides opportunities for plan sponsors to apply for and receive federal subsidies in respect of prescription drug benefits provided under qualifying group health plan(s) for plan years beginning on or after January 1, 2006; and WHEREAS,the City of Everett has retained the services of Part D Advisors, Inc. ("PDA")to assist the City of Everett in the preparation and submission to CMS of an application for subsidies available under the Drug Subsidies Program (the"Subsidy Application"), a copy of which is attached hereto as Exhibit A; and WHEREAS,the Subsidy Application requires an"Authorized Representative"of the City of Everett to execute the Subsidy Application on behalf of the City of Everett and thereby bind the City of Everett to the terms and conditions for obtaining the subsidy payment(s) under the Drug Subsidy Program; and WHEREAS,the Council desires to appoint and empower an individual with the legal authority to act on behalf of the City of Everett as its "Authorized Representative"for purposes of the Subsidy Application. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT that: the Council of City of Everett does hereby appoint, approve, and empower the Chief Financial Officer of the City of Everett to act in the name of and on behalf of the City of Everett as its "Authorized Representative"for purposes of the Subsidy Application,until further action of the Council of City of Everett;
